Description of Subjects/Issues |
Revisions to Colorado State Implementation Plan regarding Regional Haze and Regulation 3, Part G: Best Available Retrofit Technology (BART). See attached proposed rule and notice. |
Purpose/Objective of Rule |
This regulatory change places the Division's BART determinations and associated
requirements in a new section of Regulation No. 3, Part E - Section VI.
EPA has raised concerns regarding the practical enforceability of the Colorado's BART determinations. The emission limits and averaging times for each of Colorado's BART sources will be included in each Title V permit, and included in the proposed SIP. The Title V permits and the SIP are each federally enforceable when approved by EPA. Nonetheless, EPA believes that more is needed to ensure the practical enforceability of these BART |
