Length of Restraint and Issuance of Probationary License |
Purpose/Objective of Rule |
These rules are being promulgated to bring the Hearings Division into greater compliance with new statutes and case law. The previous rules (1 CCR 204-8) governing length of restraints and decisions about probationary licenses were limited to the Points Law under ?42-2-127 (formerly ?42-2-123). In the past decade, several laws have been enacted that grant authority to the Division to issue or deny a probationary license and fix the particular length of restraint. These rules are being promulgated in order to give regulatory guidance to Hearing Officers in the determination of those discretion |
