The proposed amendments are intended to implement SB 04-159 by eliminating the collection and preservation of a delayed breath alcohol specimen for DUI testing and instituting a second direct evidential breath alcohol test. |
Purpose/Objective of Rule |
These amendments are intended to implement SB 04-159 by eliminating the collection and preservation of a delayed breath alcohol specimen for DUI testing and instituting a second direct evidential breath alcohol test. The second evidential breath alcohol test (EBAT) confirms the accuracy of the first evidential breath alcohol test and improves mouth alcohol detection.
