Description of Subjects/Issues |
42-4-235 (4)(a), CRS, provides the Chief of the CSP with the authority to adopt rules and regulations setting minimum standards for the operation of commercial vehicles within Colorado. These rules are reflected in the CCR as 8 CCR 1507-1. For this rulemaking, amendments are being proposed to 8 CCR 1507-1:
1)In response to recent changes in statute codified by the passage of Colorado Senate Bill 23-012, which amended both section 42-4-235 and 42-3-120, CRS, affecting the treatment of intrastate motor carriers concerning cooperation with compliance reviews and the resolution of civil penalties.
2)Updating references to the CRS, CVSA Inspector, CVSA OOS Criteria, and FMCSRs to maintain consistency with controlling and authorizing legal authorities.
3)Clarifying the processes and resources associated with the assignment, determination, assessment, and review of Safety Fitness Rating and Civil Penalties; and
4)Correcting minor errors in grammar, editing, spelling, formatting, and updating references to online resources throughout. |
Purpose/Objective of Rule |
The objective of these rules is to regulate the transportation of commercial motor vehicles within the state of Colorado. Under 42-4-235 (4) (a0 (I), CRS, the Chief of the CSP has the authority to adopt rules and regulations establishing the minimum standards for the operation of CMVs within Colorado. The amendments adopted to these rules are for the purpose of:
1)Responding to changes in statute codified by the passage of SB 23-012, amending both 42-4-235 and 42-3-120, CRS, affecting the treatment of intrastate motor carriers concerning cooperation with compliance reviews and resolution of civil penalties.
2) Updating references to the CRS, CVSA Inspector and OOS Criteria, and the FMCSRs to maintain consistency with controlling and authorizing legal authorities.
3)Clarifying the processes and resources associated with the assignment, determination, assessment, and review of Safety Fitness Rating and Civil Penalties; and
4)Correcting minor errors in grammar, editing, spelling, formatting, and updating reference to online resources cited throughout the rules. |
