Description of Subjects/Issues HB 22-1278 created the Behavioral Health Administration (BHA) and therein required the BHA to promulgate rules related to licensing Behavioral Health Entities. Section 27-50-106, C.R.S. transfers the licensing authority of the Behavioral Health Entity (BHE) license from the Colorado Department of Public Health and Environment (CDPHE) to the BHA. Section 27-50-107(3), C.R.S. gives the BHA authority to promulgate rules related to conditions that behavioral health programs and entities must meet for licensure, and 27-50-502 gives the BHA authority to set minimum standards for the operation of BHEs within the state. This rule filing will supersede previously noticed rulemaking SOS 2023-00076.

Comments CDHS holds two public hearings, an initial and final, for each proposed rule packet. The initial hearing allows the public an opportunity to submit written data, views, or arguments and to testify for or against the proposed rules. The Board does not vote on the proposed rule at the initial hearing, but asks CDHS to consider all public comment and discussion and, if needed, submit revisions to the proposed rule. The final hearing, usually the month following the initial hearing, allows the same opportunity for public comment, after which the Board votes on final adoption of the proposed rule.
