| Description of Subjects/Issues |
The rule updates are designed to align with federal standards, reflect current industry practices, and incorporate recommendations from Colorado school transportation professionals. In addition, various “clean up” language changes have been incorporated to provide more clarification on the requirements.
The original rulemaking process had been terminated because throughout the rules, the Federal Motor Vehicle Safety Standards are incorporated. When other standards are incorporated, we are required to comply with a very specific set of requirements. The incorporated standards need to be identified not only by name, but also by date/version, and what is supposed to be included in the rulemaking are explanations of where those standards can be found. This rulemaking hearing will allow the federal standards to be properly incorporated into the rules. |
| Purpose/Objective of Rule |
At the April 2023, meeting, the State Board of Education approved the Rules for the Colorado Minimum Standards Governing School Transportation Vehicles, 1 CCR 301-25 which included incorporating the Federal Motor Vehicle Safety Standards. That rulemaking overlooked the need to comply with Section 24-4-103(12.5), C.R.S. when incorporating federal standards by reference. Therefore, the prior rulemaking has been terminated. This rulemaking re-adopts the same changes as were previously adopted in April but adds in the required statement so that the federal standards to be incorporated in the correct manner. |
