Description of Subjects/Issues In Senate Bill 22-114, the General Assembly determined that more resources are needed for wildfire mitigation to reduce fire risk and to keep fires from becoming large and catastrophic. The General Assembly further found that remote areas in Colorado lack sufficient resources to suppress fires without external support. To address these concerns, the General Assembly declared that it is in the public interest to create a process to identify, designate, and preserve critical fire suppression ponds. The purpose of this rule is to establish the criteria for Boards of County Commissioners, in consultation with Fire Protection Districts or Fire Authorities, to identify and evaluate potential fire suppression ponds. Senate Bill 22-114 section 2(5)(a) requires the Director of the Division of Fire Prevention and Control to promulgate these rules on or before May 1, 2023.
Purpose/Objective of Rule Pursuant to Section 24-33.5-1203.5, C.R.S., the Director of the Colorado Division of Fire Prevention and Control shall promulgate rules as necessary to carry out the duties of the Division of Fire Prevention and Control. This rule is proposed pursuant to this authority and is intended to be consistent with the requirements of the State Administrative Procedures Act, Section 24-4-101, et seq., C.R.S. In Senate Bill 22-114, the General Assembly determined that more resources are needed for wildfire mitigation to reduce fire risk and to keep fires from becoming large and catastrophic.
