Description of Subjects/Issues Justification for emergency: Senate Bill 21-199 eliminated lawful presence as a requirement for state funded programs. An initial rule was passed updating Adult Financial Programs that was effective July 1, 2022. However, upon further review, additional rule updates are needed to fully comply with the legislation.

Comments CDHS typically holds 2 public hearings, an initial and final, for each proposed rule. Initial hearing allows public an opportunity to submit written data, views or arguments and to testify for or against the proposed rules. The Board doesn't vote on the proposed rule at initial hearing, but asks CDHS to consider public comment and discussion and, if needed, submit revisions to the proposed rule. Final hearing, usually the month following the initial hearing, allows the same opportunity for public comment, after which the Board votes on final adoption of the proposed rule. Emergency rules (ER) are adopted immediately, and are permanently adopted at a second hearing, usually the month after the initial hearing. It is anticipated that this hearing will permanently adopt an ER adopted 12/9/2022 (SOS2022-00785), replacing previously noticed rulemaking 2022-00697.
