Additional Information
Statutory Authority 26-1-107(5)(a)(I), (b), C.R.S.; 26-1-111(2)(a), C.R.S.; 26-2-137(1)(b), C.R.S.; 26-2-138(3)-(5), C.R.S.; Pub. L. 117-128, Title IV, § 401(a), (b); 8 U.S.C. 1101 note “Benefits for Certain Citizens or Nationals of Ukraine”; 8 U.S.C. §§ 1522(a)(2), (6)
Purpose/Objective of Rule Ukrainian Humanitarian Parolees were made eligible immediately for benefits and services in the federal Additional Ukraine Supplemental Appropriations Act. Current rules do not allow eligibility for this population and are out of alignment with the new federal law. Thus, ensuring the inclusion of their new categories and verification of status documents in the state rules, will bring uniform knowledge of categories, public benefits eligibility, and support from all parties involved, and allow CRSP to provide services to this population. Statutory Authority 26-1-107(5)(a)(I), (b), C.R.S.; 26-1-111(2)(a), C.R.

Comments CDHS typically holds 2 public hearings, an initial and final, for each proposed rule. The initial hearing allowing the public an opportunity to submit written data, views, or arguments and to testify for or against the proposed rules. The Board does not vote on the proposed rule at the initial hearing, but asks CDHS to consider all public comment and discussion and, if needed, submit revisions to the proposed rule. The final hearing, usually the month following the initial hearing, allows the same opportunity for public comment, after which the Board votes on final adoption of the proposed rule. Emergency rules (ER) are adopted immediately, and are permanently adopted at a second hearing, usually the month after the initial hearing. This hearing adopted an ER which is anticipated to be adopted on a permanent basis through SOS#2022-00528.
