Description of Subjects/Issues |
The Supplemental Nutrition Assistance Program (SNAP) is a Food Assistance program in Colorado, formerly known as Food Stamps. SNAP provides food assistance benefits as part of a federal nutrition program to help low-income households purchase food. The United States Department of Agriculture, Food and Nutrition Service annually evaluates Federal income poverty guidelines and cost of living increases to determine appropriate adjustments to income eligibility standards, benefit allotments, and deductions for the upcoming Federal Fiscal Year (FFY). The modified figures are typically made available to states during the month of August immediately prior to the next fiscal year. The COLA changes in this regulation package are required to become effective 10/01/2022. Additionally, recent legislative changes have moved the Office of Appeals operation under the Colorado Department of Human Services (CDHS), requiring updates to regulations to reflect the administrative change. |
Purpose/Objective of Rule |
The Supplemental Nutrition Assistance Program (SNAP) is a Food Assistance program in Colorado, formerly known as Food Stamps. SNAP provides food assistance benefits as part of a federal nutrition program to help low-income households purchase food. The United States Department of Agriculture, Food and Nutrition Service (FNS) annually evaluates Federal income poverty guidelines and cost of living adjustments (COLA) to determine appropriate adjustments to income eligibility standards, benefit allotments, and deductions for the upcoming Federal Fiscal Year (FFY). The modified figures are typically made available to states during the month of August immediately prior to the next fiscal year. The COLA changes in this regulation package are required to become effective 10/01/2022. Additionally, in order to comply with federal requirements around fair hearings timeliness and help resolve Colorado’s Corrective Action Plan (CAP), all SNAP fair hearings are to be heard under the Office of Appeals (OOA) within Colorado Department of Human Services (CDHS), requiring updates to regulations to reflect the administrative change. |

Comments |
CDHS typically holds 2 public hearings, an initial and final, for each proposed rule. The initial hearing allowing the public an opportunity to submit written data, views, or arguments and to testify for or against the proposed rules. The Board does not vote on the proposed rule at the initial hearing, but asks CDHS to consider all public comment and discussion and, if needed, submit revisions to the proposed rule. The final hearing, usually the month following the initial hearing, allows the same opportunity for public comment, after which the Board votes on final adoption of the proposed rule.
