Statutory Authority Pursuant to Section 24-33.5-1203.5, C.R.S., the Director of the Colorado Division of Fire Prevention and Control shall promulgate rules as necessary to carry out the duties of the Division of Fire Prevention and Control. This rule is proposed pursuant to this authority and is intended to be consistent with the requirements of the State Administrative Procedures Act, Section 24-4-101, et seq., C.R.S.
Description of Subjects/Issues On June 17, 2022, DFPC adopted amended emergency rules for Fire Suppression; this hearing will be to provide stakeholder input on permanent rulemaking for those amended rules. The purpose of this rule change is to: -Allow an exemption to Rule 5.4.3 to provide fire sprinkler fitter renewal applicants an extension on the deadline to pass required exams, in recognition of the limited certified testing options currently available. -Create a separate contractor and inspector category for pre-manufactured housing that is being constructed out-of-state and transported into Colorado for final construction, in order to ensure this type of housing is able to meet Colorado standards for fire suppression systems. -Complete general clean-up of grammatical and formatting inconsistencies or errors.
Purpose/Objective of Rule Pursuant to Section 24-33.5-1203.5, C.R.S., the Director of the Colorado Division of Fire Prevention and Control shall promulgate rules as necessary to carry out the duties of the Division of Fire Prevention and Control. This rule is proposed pursuant to this authority and is intended to be consistent with the requirements of the State Administrative Procedures Act, Section 24-4-101, et seq., C.R.S. The purpose of this rule change is to allow an exemption to Rule 5.4.3 to renewal applicants. As written in the current rules, the applicant must pass a Division approved examination pertinent to the currently adopted codes and standards. Out of the four examinations accepted by the Division, only two encompass the current codes. Due to time constraints for renewals and the large amount of fire sprinkler fitters that need to be registered for the 2022 period, the extension will alleviate the immediate need for signing up and passing an exam prior to July 30, 2022. Additionally, with the increase in the need for affordable housing, Colorado has seen an increase in the construction of premanufactured housing across the state to meet this need. The rules, as previously written, do not address this type of construction, where the suppression system is installed in a central manufacturing location and then is transported to its final installation site in Colorado for final construction. To ensure the suppression systems that are being installed in these premanufactured buildings are meeting the same requirements of other suppression systems installed in Colorado, it is necessary to create a separate contractor and inspector category to accommodate this work. This rule change accomplishes this. This rule change also allows for general clean-up of grammatical and formatting inconsistencies or errors.
