Description of Subjects/Issues This rule is anticipated to be adopted as an Executive Director Rule, with the rule being considered at a public meeting following the April 8, 2022 State Board of Human Services meeting. Section 27-60-108(3)(c) (H21-1021) charged CDHS with Executive Director rules to establish minimum standards that recovery support services organizations must meet to bill Medicaid. The rules must be implemented by July 1, 2022, as that is the state’s stator deadline for developing a procedure to ensure recovery support services organizations be approved by the executive director for reimbursement. Comments CDHS typically holds two public hearings, an initial and final, for each proposed rule packet. The initial hearing allows the public an opportunity to submit written data, views, or arguments and to testify for or against the proposed rules. The Executive Director does adopt the proposed rule at the initial hearing, but asks staff to consider all public comment and discussion and, if needed, submit revisions to the proposed rule. The final hearing, usually the month following the initial hearing, allows the same opportunity for public comment, after which the Executive Director decides on final adoption of the proposed rule.
