Description of Subjects/Issues |
The Department is working to align citizenship and date of birth verification rules with the Operational Memo OM-ECL-2021-0002 which provided clarification on how a child's citizenship and date of birth should be verified. This memo guides counties to use preponderance of evidence when verifying citizenship and date of birth, accepting the client's statement unless there is reason to believe that the client's statement is questionable. This same approach would be taken to verify a child's identity as well. This change impacts the processes for the Low-Income, Colorado Works, and Protective Services Child Care programs. The revisions reduce the burden on families and reduce a county's workload since they require less verification from the family. Purpose/Objective of Rule |

Comments |
CDHS holds two public hearings, an initial and final, for each proposed rule packet. The initial hearing allows the public an opportunity to submit written data, views, or arguments and to testify for or against the proposed rules. The Board does not vote on the proposed rule at the initial hearing, but asks CDHS to consider all public comment and discussion and, if needed, submit revisions to the proposed rule. The final hearing, usually the month following the initial hearing, allows the same opportunity for public comment, after which the Board votes on final adoption of the proposed rule.
