| Description of Subjects/Issues |
Rule 7-300 and 7-500. This proposed amendment aligns this rule with §44-7-104(5)(a)(II) C.R.S., which allows retailers with more than 10 retail locations to apply with the Division as a large-operator. The amendment corrects the current language of the rule that allows retailers with 10 or more retail locations to apply as a large-operator.
Rule 7-601. This proposed amendment adds a new subparagraph under paragraph (H) that mirrors penalties required by statute. A retailer that sells or offers to sell cigarettes, tobacco products, or nicotine products without displaying a warning sign for a fifth time in a 24-month period is required to face a penalty of at least $250.00 but not more than $1,000.00 according to §44-7-106(4)(b)(IV) C.R.S. The rule previously did not list penalties for the fifth violation. |

Tobaccos rules have been updated in order to clarify that a large operator must have more than ten retail locations. Penalty rules have also been update to reflect all statutory penalties. |
