Description of Subjects/Issues |
To implement House Bill 2021-1019 concerning modifications to the regulations of factory-built structures signed into law by Governor Jared Polis on May 10, 2021, and in the process ensure at a minimum the following are addressed in the rules:
- the rules stay consistent with the changes made in law
- define new terms used in the bill
- modify equipment enclosures exception
- make permanent an emergency/temporary rule to address an electric code issue
- establish a performance bond amount and process for installers
- establish a liability insurance amount and process for installers
- clarify the education, experience, and training requirements for installers and inspectors, including the installation and inspection/certification process for multi-family structures
- clarify escrow requirements for sellers
- establish bond amount and process for sellers
- clean up formatting, citations, update language, remove unnecessary language, etc. |

The Division conducted four stakeholder meetings to inform the
drafting of these proposed amended rules that were then considered at a rulemaking hearing that took place virtually from 12:24 PM to 12:35 PM on Tuesday, July 13, 2021. Stakeholders were invited and encouraged to submit written testimony for consideration prior to the rulemaking hearing by directing their written testimony to the State Housing Board and emailing it to maulid.miskell@state.co.us by 5:00 pm on Monday, June 28, 2021. Stakeholders were also welcomed to participate during the rulemaking hearing by providing verbal testimony and/or written testimony for the State Housing Board's consideration by completing and submitting a Google Form that was provided. One member of the public provided written and verbal testimony for the Board's consideration at the rulemaking hearing. After concluding the hearing, the Board moved to adopt the proposed rules as further amended in response to the testimony received. |
