Description of Subjects/Issues |
HB 19-1147 is the impetus for this rule packet. The bill changed the Trust Fund statute in the following ways that require revisions to these rules.; The word "traumatic" was removed from the titles of the Trust Fund and Board and the definition was changed from “traumatic brain injury” to "brain injury"; The bill enables the Board to expand services to include those with non TBI as well as prioritize services and eligibility for services while ensuring fidelity to the program's original intent to serve individuals with brain injuries; The bill updated outdated and unnecessary language, including the removal of “partner” and “subrogation”, as well as changing “care coordination” to “service coordination and skills training” and “Brain Injury Program” to “MINDSOURCE – Brain Injury Network”. The purpose of these proposed rule changes is to ensure that the rules reflect the current statute language and intent and to remove unnecessary language in the rules. |

Comments |
CDHS holds two public hearings, an initial and final, for each proposed rule packet. The initial hearing allows the public an opportunity to submit written data, views, or arguments and to testify for or against the proposed rules. The Board does not vote on the proposed rule at the initial hearing, but asks CDHS to consider all public comment and discussion and, if needed, submit revisions to the proposed rule. The final hearing, usually the month following the initial hearing, allows the same opportunity for public comment, after which the Board votes on final adoption of the proposed rule.
