Statutory Authority Sections 25-7-105(1)(b); 25-7-109(2)(h) and 109(4); 24-4-103 and 25-7-110, 110.5 and 110.8 C.R.S., as applicable and amended.
Description of Subjects/Issues To consider revisions to Regulation Number 8, Parts A and E to incorporate by reference additions and changes that the U.S. Environmental Protection Agency made to its National Emission Standards for Hazardous Air Pollutants (NESHAP) in 40 C.F.R. Part 61 and Maximum Achievable Control Technology (MACT) standards in 40 C.F.R. Part 63. The Division proposes to adopt, by incorporating by reference, specific federal rules and rule revisions that already apply on a federal basis. Colorado already has a robust air pollution control program, and incorporating recently promulgated federal requirements into the State's program streamlines the compliance process for affected sources.
