Description of Subjects/Issues |
New Rule: The kinship rule that guides the child welfare practice when children and youth are placed with kin needs to be updated to set time limitations on how long a child can remain in a non-certified kinship home and in county custody. Amended Rule: Will allow flexibility for county human services directors to name a designee to authorize kinship living arrangements when the county department does not have custody or authority for placement, and there is a disqualifying factor in the home of the potential kinship living arrangement. These rules allow for more children and youth to stay with safe and appropriate relatives or kin, reducing the need for higher levels of placement. These rules will impact county departments and kinship families. It will allow county departments greater flexibility in who can affirm kinship living arrangements, which allows for more children and youth to stay with safe and appropriate relatives or kin, reducing the need for higher levels of placement.

Comments |
CDHS holds two public hearings, an initial and final, for each proposed rule packet. The initial hearing allows the public an opportunity to submit written data, views, or arguments and to testify for or against the proposed rules. The Board does not vote on the proposed rule at the initial hearing, but asks CDHS to consider all public comment and discussion and, if needed, submit revisions to the proposed rule. The final hearing, usually the month following the initial hearing,
allows the same opportunity for public comment, after which the Board votes on final adoption of the proposed rule.
