Description of Subjects/Issues The Colorado Public Utilities Commission issues this Notice of Proposed Rulemaking (NOPR) to amend the Commission’s Rules Regulating Electric Utilities, 4 Code of Colorado Regulations (CCR) 723-3 (Electric Rules) and Rules Regulating Gas Utilities and Pipeline Operators, 4 CCR 723-4 (Gas Rules). The proposed amendments revise the Billing and Service sections of the Electric and Gas Rules as they relate to the conditions under which customers can be disconnected for nonpayment, including the disconnection process, disconnection notice, payment plans, and reconnection process. The proposed amendments also impact Electric Rule 3413, on medical exemptions from tiered electric rate plan. This rulemaking satisfies the requirements of Senate Bill (SB) 20-030, codified at § 40-3-103.6, C.R.S., that the Commission commence by September 1, 2020, a rulemaking to consider standard practices for electric and gas utilities to apply when discontinuing service due to nonpayment. SB 20-030 also codified changes to § 40-3-103.5, C.R.S., on medical exemption rate programs, § 40-3-106, C.R.S., on revenue neutrality, and § 40-3-110, C.R.S., on reporting requirements, that are addressed within this Notice of Proposed Rulemaking.

Comments On September 10, 2021, the Commission issued a decision adopting rules revisions. Exceptions were filed on September 30, 2021 and on October 29, 2021, the Commission issued a decision granting, in part, and denying, in part, exceptions. Applications for rehearing, reargument or reconsideration were due by November 18, 2021 and no applications were filed. The rules became final on November 18, 2021.
