Description of Subjects/Issues |
The current rule has descriptions of work activities that are inconsistent with Colorado’s new Work Verification Plan. In addition, the current assessment rule is outdated and requires more than what is federally required. The proposed rule eliminates references to work activities as previously federally defined in the Work Verification Plan. The new rule will refer back to the Work Verification Plan for consistency. The section addressing assessments will be updated to match the federal language. The current rule does not list the statutorily required disqualification period for Intentional Program Violations.

Purpose/Objective of Rule |
Colorado Works is Colorado's Temporary Assistance for Needy Families (TANF) program. Through the program, participants receive help becoming self-sufficient by strengthening their family's economic and social stability. The current Colorado Works rules have descriptions of work activities that are inconsistent with Colorado’s new federally approved Work Verification Plan. In addition, Colorado’s current assessment rule is outdated and requires more than what is federally required. To address this issue, the proposed rule modifies references to work activities as previously federally defined in the Work Verification Plan and incorporates the Work Verification Plan by reference for consistency. The section addressing assessments is also updated to match federal language for consistency.
Finally, the current rule is inconsistent with State statute as it does not list the mandatory disqualification period for Intentional Program Violations. |

Comments |
CDHS holds two public hearings, an initial and final, for each proposed rule packet. The initial hearing allows the public an opportunity to submit written data, views, or arguments and to testify for or against the proposed rules. The Board does not vote on the proposed rule at the initial hearing, but asks CDHS to consider all public comment and discussion and, if needed, submit revisions to the proposed rule. The final hearing, usually the month following the initial hearing, allows the same opportunity for public comment, after which the Board votes on final adoption of the proposed rule.
