Description of Subjects/Issues |
The purpose of this rulemaking is to update rule (80.6) related to pregnancy, childbirth, and related conditions to reflect recent statutory amendments to the Colorado Anti-Discrimination Act, specifically § 24-34-402.3, C.R.S. aka the "Pregnant Workers Fairness Act." Updates to the pregnancy rule include the requirement for an employer to provide reasonable accommodations for employees who may be pregnant, recovering from childbirth, or a related condition, as well as a requirement to inform employees of their entitlement to such accommodations. An additional purpose of the rulemaking is to expand methods by which parties may file charges with the Civil Rights Division, to expand the methods by which the Division may serve copies of any charge upon the parties, to eliminate the option for oral argument to the Commission on an appeal of the Director’s finding of no probable cause, and to clarify the good-cause standard related to the Commission’s review of requests for extensions, and to amend the rule regarding harassment based on sexual harassment to clarify harassment because of sexual orientation may include adverse treatment following the disclosure or discussion of one's gender expression, transgender status, and/or sexual orientation.” |
