Statutory Authority Statutory authority for these rules is found in Sections 29-22-104 (6)(A) and 29-22-104 (6)(b) of the Colorado Revised Statutes.
Description of Subjects/Issues Amendments are being proposed to 8 CCR 1507-22 following a department rule review to assess these rules. The review discovered that the email address provided in the rules to Designated Emergency Response Authorities (DERAs) needed to be corrected and that a citation for the reference to the FEMA schedule of equipment rates within the rules needed to be added to satisfy the requirements of 24-4-103 (12.5), CRS. This review also identified minor grammar and editing items that needed revision throughout the document. None of these proposed amendments make substantive changes to the content or the present interpretation of these rules.
Purpose/Objective of Rule The purpose of these rules is to create a process by which a public entity, political subdivision of the state, or a unit of local government claiming reimbursement for costs attributable to a hazardous materials incident response or mitigation. These rules also establish a process by which parties involved in a dispute over claims for reimbursement may access and receive assistance from qualified, knowledgeable persons. The proposed amendments to this rule do not change existing interpretation or content. The changes proposed update the contact email address for the CSP HM Section used by DERAs to provide information; include references as required by 24-4-103 (12.5), CRS, for referenced guidelines or sources; include reference to the reimbursement rats scheduled calculated internally by the CSP for expenses incurred by the CSP when the CSP responds to or mitigates hazardous materials incidents; and correct minor grammar and formatting items.
