Description of Subjects/Issues The Colorado Public Utilities Commission issues this Notice of Proposed Rulemaking to amend the rules governing towing carriers comprising Rules 6500 through 6514 of the Commission’s Rules Regulating Transportation by Motor Vehicle, 4 Code of Colorado Regulations (CCR) 723-6 (Towing Carrier Rules). We open this rulemaking following consideration of a petition for rulemaking filed by members of the towing industry and a stakeholder outreach proceeding led by Staff.
Purpose/Objective of Rule The Colorado Public Utilities Commission issues this Notice of Proposed Rulemaking to amend the rules governing towing carriers comprising Rules 6500 through 6514 of the Commission’s Rules Regulating Transportation by Motor Vehicle, 4 Code of Colorado Regulations (CCR) 723-6 (Towing Carrier Rules). We open this rulemaking following consideration of a petition for rulemaking filed by members of the towing industry and a stakeholder outreach proceeding led by Staff.

Comments On October 1, 2020, the Commission issued a decision adopting rules revisions. A motion for clarification and to extend deadline for filing exceptions was filed on October 19, 2020 and on October 21, 2020, the Commission issued an interim decision construing motion as exceptions and remanding the proceeding to the Administrative Law Judge. On November 6, 2020, a recommended decision was issued granting in part and denying in part TRPC’s motion and clarifying Recommended Decision No. R20-0688. On December 3, 2020, a motion to late file exceptions was filed and on December 9, 2020, a decision was issued denying motion to allow late filed exceptions. Applications for rehearing, reargument or reconsideration were due by December 21, 2020 and no applications were filed. The rules became final December 21, 2020.
