| Description of Subjects/Issues |
The Colorado Public Utilities Commission issues this Notice of Proposed Rulemaking to amend the rules governing Community Solar Gardens within the Commission’s Rules Regulating Electric Utilities, 4 Code of Colorado Regulations 723-3. The Commission’s Community Solar Gardens Rules implement § 40-2-127, C.R.S. The Community Solar Gardens Rules are presently located within the Renewable Energy Standard Rules (RES Rules) at 4 CCR 723-3-3650 et seq. This Notice of Proposed Rulemaking proposes to move the Community Solar Gardens Rules to a new standalone section within 4 CCR 723-3, comprising Rules 4 CCR 723-3-3875 et seq. This Notice of Proposed Rulemaking also proposes substantive changes to the Community Solar Gardens Rules, as described in this Decision and its attachments. |

On April 6, 2020, the Commission issued a decision adopting rules revisions. Exceptions were filed on April 27, 2020 and on July 9, 2020 the Commission issued a decision granting, in part, and denying, in part, exceptions. Applications for rehearing, reargument or reconsideration were filed on July 29, 2020. On August 28, 2020, the Commission issued a decision granting, in part, and denying, in part, applications for rehearing, reargument or reconsideration. A 2nd round of applications for rehearing, reargument or reconsideration were due by September 17, 2020 and no applications were filed. The rules became final September 17, 2020. |
