Description of Subjects/Issues |
The proposed amendments are issued by the Commission upon its own initiative, and pursuant to changes to certain business practices of the Commission as set forth in Senate Bill 19-236 enacted by the Colorado General Assembly in the 2019 legislative session. The purpose of our Practice and Procedure Rules is to “advise the public, regulated entities, attorneys, and any other person of the Commission’s rules of practice and procedure … in order to properly administer and enforce the provisions of Title 40 of the Colorado Revised Statutes and in order to regulate proceedings before the Commission.” The purpose of this Notice of Proposed Rulemaking is for the Commission to solicit comments on possible changes to the Practice and Procedure Rules as described in this Decision and its attachments, and to schedule a rulemaking hearing. |

Comments |
On December 23, 2019, the Commission issued a decision adopting rules revisions. Exceptions were filed on January 13, 2020 and on March 30, 2020 the Commission issued a decision granting in part and denying in part exceptions. Applications for rehearing, reargument or reconsideration were filed on April 20, 2020. On May 19, 2020, the Commission issued a decision denying the application from the Colorado Energy Office and granting in part and denying in part the application from Western Resource Advocates. A 2nd round of applications for rehearing, reargument or reconsideration were due by June 8, 2020 and no applications were filed. The rules became final June 8, 2020. |
