| Description of Subjects/Issues |
The basis of these rules, adopted by the State Board of Education, is found in 22-2-117, C.R.S. and 22-30.5-104(6). The purpose of these rules is to clarify the process that schools and school districts must follow to seek waivers from statutes or rules. In addition, the rules specify the process by which the State Board may grant waivers to charter schools and clarify the standards that the State Board will use in determining which waiver requests meet the statutory requirements. |
| Purpose/Objective of Rule |
In the winter of 2018, the Office of Legislative Legal Services (OLLS) noted a drafting error in the most recent rule revision of 1 CCR 301-35. The resulting draft reflects those technical changes as suggested by OLLS, CDE staff, and the Attorney General’s Office.
At the March 14, 2019, State Board of Education meeting, the Board approved the Notice of Rulemaking for the Rules for the Administration of the Waiver of Statute and Rule.
The Board is asked to take action by approving the rules for the Administration of the Waiver of Statute and Rule, 1 CCR 301-35. |
