Statutory Authority Pursuant to Section 24-33.5-1203.5, C.R.S., the Director of the Colorado Division of Fire Prevention and Control shall promulgate rules as necessary to carry out the duties of the Division of Fire Prevention and Control.
Description of Subjects/Issues First, this rule change addresses deficiencies in the rule. Sections 3.9.1.4 and 5.5.1.4 incorporate by reference the procedure for denial of a registration from the State ADPA. Section 10 incorporates by reference the procedure for suspension or revocation of a registration from the State APA. These changes to the rule are required in order to ensure that Sections 3.9.1.4, 5.5.1.4, and 10 fully comply with the statutory requirements for the procedures for the suspension, denial, or revocation of a registration, codified at C.R.S. 24-4-104 (6). Second, this rule change removes direct references to adopted Codes and Standards under Section 2.4 and replace it with a reference to 8 CCR 1507-101 (BUILDING AND FIRE CODE ADOPTION AND CERTIFICATION OF INSPECTORS FOR FIRE & LIFE SAFETY PROGRAMS ADMINISTERED BY THE STATE OF COLORADO), which is a consolidation of all Codes and Standards referenced in the rules promulgated for the fire and life safety programs administered by DFPC. Third, this rule change removes rules and procedures for certifying fire inspectors and plan reviewers under Section 4 and replace it with a reference to 8 CCR 1507-101 (BUILDING AND FIRE CODE ADOPTION AND CERTIFICATION OF INSPECTORS FOR FIRE & LIFE SAFETY PROGRAMS ADMINISTERED BY THE STATE OF COLORADO), which is a consolidation of all inspector certifications referenced in the rules promulgated for the fire and life safety programs administered by DFPC.
