Description of Subjects/Issues |
SB 18-024 directs the Board of Health to promulgate rules to assist communities with underserved health care or behavioral health care needs by establishing the state-specific methodologies for designating areas experiencing a shortage of health care professionals or behavioral health care providers. The state-designated health professional shortage area methodology is then used by the Department, with the assistance of the Health Service Corps Advisory Council, to provide loan repayment or scholarships in exchange for services by qualifying professionals in the state-designated shortage areas. This rule is necessary for the preservation of public health, safety, or welfare and compliance with the requirements of this section would be contrary to the public interest. In addition, the rule is imperatively necessary for the department to execute the loan repayment and scholarship requirements as directed in state law, Section 25-1.5-503, C.R.S. and Section 25-1.5-503.5, C.R.S. |
Purpose/Objective of Rule |
The rulemaking updates and makes permanent, emergency rules related to a state-designated health professional shortage areas for behavioral health services. Emergency rules for 6 CCR 1015-6, State-Designated Health Professional Shortage Area Methodology were adopted by the Board of Health on August 15, 2018. |

Along with the redline, a table amendment to correct typographic errors and clarify rule language was adopted. Table Amendment changes to the Statement of Basis and Purpose include: STRIKE “fallowing” and INSERT “following”; INSERT “than” between “less” and “ideal.”; and INSERT a “.” after “seq” in “et seq”. In the Regulatory Analysis, STRIKE “directedly” and INSERT “directly” (second use of directly in the document). In the rule text, at Section 1.3(7) after “administered” INSERT “by” and in Section 1.4 after “Colorado” INSERT “using a variable two-step floating catchment area method.” |
