Description of Subjects/Issues The Colorado Public Utilities Commission issues this Notice of Proposed Rulemaking (NOPR) to amend Rule 3600 et seq. of the Commission’s Rules Regulating Electric Utilities, 4 Code of Colorado Regulations 723-3 (Electric Rules). The proposed amendment codifies House Bill 18-1270. The short title of the act is the “Energy Storage Procurement Act” (Act). The Colorado General Assembly found, determined, and declared that energy storage systems provide potential opportunities to: reduce system costs; support diversification of energy resources; and enhance grid safety and reliability. The Act, at §40-2-203(1), C.R.S., requires that on or before February 1, 2019, the Commission establishes, by rule, as part of the planning process, mechanisms for the procurement of energy storage systems by electric utilities.

Comments Decision No. C18-1124, issued on December 12, 2018 adopted rule revisions. No applications for rehearing, reargument or reconsideration were filed. The Commission Decision adopting rule revisions became final on January 2, 2019.
