Proposed revisions to Regulation Number 3, Part A that address the United States Environmental Protection Agency’s (“EPA”) final rule, Prevention of Significant Deterioration and Title V Permitting for Greenhouse Gases: Removal of Certain Vacated Elements (August 19, 2015, 80 Fed. Reg. 50199). Specifically, the Division proposes to revise the definition of “subject to regulation” in Part A, Section I.B.44.e. to correspond to EPA’s revision to the federal definition of “subject to regulation”. |
