The agency is updating the rules as they have not been updated since 1984 and it making sure it tracks APA for all of their adjudicatory and rulemaking hearings. |

As part of the update to these rules, we have included Alternative Dispute Resolution options modeled after the Federal APA Alternative Dispute Resolution Act of 1996, to provide complimentary processes to resolve disputes outside of normal adjudicatory methods. Further, in adjudicatory instances, incorporation of Water Court Rules 11 standards are encouraged, as well as clear parameters as to matters that can and cannot be brought before the State Engineer in this environment. |
