FILING TIER II REPORTS ELECTRONICALLY |
Purpose/Objective of Rule |
Pursuant to 24-33.5-1503.5 (1), C.R.S., the Director of DHSEM shall promulgate rules to provide consistency between information requested by the director and the purposes of implementation of the federal Emergency Planning and Community Right to Know Act (EPCRA). Pursuant to 24-33.5-1503.5 (2) (c), C.R.S., the Director has the powers and duties to create and adopt such forms as are necessary for the uniform reporting and management of information required by the federal act. The EPCRA requireS facilities with quantities of hazardous materials greater than the amounts provided in EPCRA to report those hazardous materials to the State Emergency Response Commission (SERC), Local Emergency Planning Committee (LEPC) and the local Fire Department. The EPCRA and C.R.S. 24-33.5-1503.5(2)(c), also provide provisions for the Director to adopt a standardized Tier II reporting form to replace the Tier II form which is required under the federal act. The Tier II regulation (8 CCR 1309-1) that existed under DOLA prior to the transfer of the Division of Emergency Management and the Colorado SERC (Colorado Emergency Planning Committee – CEPC) to CDPS is being repealed by DOLA and adopted by CDPS, with updated information and provisions in the new regulation (8 CCR 1507-42). |
