| Purpose/Objective of Rule |
Re-adoption of adjustment to fees orginally adopted and approved by the Board at a publicy noticed rulemnaking hearing held on October 22, 2013, is necessary due to a technical and procedural omission in the filing of the rule. The temporary rule concerning adjustment to fees was re-adopted by the Board on November 6, 2013, withs an effective date of December 30, 2013. The temporary/emergency rules are necessary for the preservation of the public health, safety, and welfare and such fee increase is necessary to comply with section 12-59-116(3), of the Colorado Revised Statutes to permit the Board to continue carrying out its statutory duties, which include, among other things, protecting the public.
The statutory basis for the amendments to the Rules is found in, but not necessarily limited to sections 12-59-105.3(1)(j), (l), 12-59-116(3) and 24-4-103(6). |
