Purpose/Objective of Rule The purpose of this regulation is to facilitate the reporting of suspected insurance fraud, to aid in the detection, investigation and ultimate prosecution of those who commit insurance fraud in this state and to deter future fraudulent acts by improving regulatory oversight of licensed persons who commit insurance fraud. This regulation describes the procedure and circumstances under which all insurers shall, and individuals may, report suspected insurance fraud for the purpose of investigating, and enforcing laws prohibiting insurance fraud.
Comments The Division of Insurance re-adopted Regulation 6-5-1 due to the failure to meet the 20 day filing deadline mandated by 24-4-103(11)(b)(II), C.R.S. The original Secretary of State tracking number for 6-5-1 was 2013-00735. The Division of Insurance did not make any substantive changes to the regulation upon re-adoption. The hearing for Regulation 6-5-1 was held on August 15, 2013 and the regulation was originally adopted on September 3, 2013.
