| Purpose/Objective of Rule |
The purpose of this regulation is to establish rules governing enrollment periods for individual and group health benefit plans in accordance with Article 16 of Title 10 of Colorado Revised Statutes, and the Patient Protection and Affordable Care Act of 2010, Pub. L. No. 111-148, 124 Stat. 119 (2010), and the Health Care and Education Reconciliation Act of 2010, Pub. L. No. 111-152, 124 Stat. 1029 (2010), together referred to as the “Affordable Care Act” (ACA). This regulation replaces emergency regulation E-13-09 in its entirety. |

The regulation was amended to clarify that coverage effective dates for marriage and civil unions would be treated equally and the regulation was re-adopted on September 20, 2013. PLEASE TAKE NOTICE that the Division of Insurance has terminated the rulemaking proceedings for proposed regulation 4-2-43, "Enrollment periods relating to individual and group health benefit plans" , without adoption of a rule.
This rulemaking as been terminated as additional substantive language was identified for inclusion within the regulation. Revisions to the regulation are underway and a revised proposed regulation 4-2-43 will be noticed for hearing in the near future. A draft will be sent out for external review shortly, and comments are requested concerning the added language surrounding special enrollment periods and the ability of consumers to shop for a plan if they know a special enrollment triggering event will occur in the immediate future.
