Description of Subjects/Issues |
To consider revisions to the Common Provisions Regulation and Regulation Number 3 that are consistent with, and as stringent as, EPA?s GHG Tailoring Rule. |
Purpose/Objective of Rule |
To consider revisions to the Common Provisions Regulation and Regulation Number 3 that are consistent with, and as stringent as, EPA?s GHG Tailoring Rule. The proposed revisions would incorporate EPA?s GHG Tailoring Rule into the Title V and PSD Permitting Programs, and support synthetic minor permitting at stationary sources seeking federally enforceable limits to avoid major source or major stationary source applicability thresholds specific to GHG. The Commission will consider revisions to the regulations to add the definitions of greenhouse gas, carbon dioxide equivalent and subject to regulation, revise the definition of major source and regulated pollutant, revise the annual fees to exclude greenhouse gas emissions, allow for synthetic minor source permitting, and make the rule effective January 2, 2011. Additionally, the Division proposes revisions to make typographical, grammatical and formatting changes as necessary. |
