Description of Subjects/Issues |
The proposed rules will establish the use and regulation of specific hybrid vehicles and will include a description of the following: identification of Hybrid Vehicles allowed to use the HOV/HOT lanes; the permitting process for the allowed Hybrid Vehicles; the duration of the program; the priority of vehicles; the suspension or revocation process; and other administrative provisions deemed necessary for the full implementation of the program. |
Purpose/Objective of Rule |
The purpose of this hearing was to adopt rules for the use and benefit of the Colorado Department of Transportation [CDOT] to regulate hybrid vehicle use of HOV/HOT lanes. Under the provisions in ? 42-4-1012, the Department of Revenue has the specific statutory authority to adopt such rules. While this inter-departmental involvement for rulemaking is somewhat unique, the two agencies have congruent statutory responsibility because of DOR's laws regulating vehicles and traffic and CDOT?s statutes concerning transportation in general. |
