Description of Subjects/Issues |
Amendments to Standards for Hospitals and Health Facilities, Chapter VII, Assisted Living Residences, Sections 1.104(5)(l)(i) and 1.107(4)(a)(iii), change the term ?legal representative? to ?next of kin? in the context of who can donate unused medications to an assisted living facility for the purposes of redispensing, as authorized by Section 12-22-133, C.R.S. |
Purpose/Objective of Rule |
To make corrections to regulations promulgated by the Board of Health on May 5, 2006 pertaining to the donation of medications in assisted living residences so that regulatory provisions mirror state law. The Office of Legislative Legal Services (OLLS) has determined that there is a conflict between the Board?s rules and the statute in the following provisions of 6 CCR 1011-1, Chapter VII, Assisted Living Residences: Section 1.104 (5)(l)(i) and Section 1.107 (4) (a) (iii).
